Understanding Long Term Capital Gain on Sale of Property in India

Written by Jainam Resources resources.jainam

Last Updated on: June 20, 2026

Overview

Budget 2024 rewrote the tax rules for property sales in India, effective July 23, 2024. Finance Act 2024 introduced what is now called the new capital gain tax regime for property: 12.5% without indexation. For property bought before July 23, 2024, both the old 20% with indexation and the new 12.5% without indexation are available. You pay whichever produces less tax.

What is Capital Gains Tax in India?

Sell a property at a profit that profit is a capital gain, which is subject to government taxes.

What is long term capital gains tax on property: the flat-rate tax on profit from property held more than 24 months, not your income tax slab but a separate flat rate.

Hold 25 months: long term capital gain on sale of property, taxed at 12.5%.

Hold 23 months: short-term, slab rate, up to 30%.

One month difference: potentially lakhs in extra tax.

It is not the same as equity LTCG; rather equity is 12 months, and property is 24 months.

How is Long Term Capital Gain Tax Calculated in India?

Indexation does not always reduce tax. Example: bought 2019 for Rs. 60 lakh, sold 2026 for Rs. 1.4 crore.

Step 1 – Net sale price: Rs. 1.4 crore minus brokerage and transfer costs. Call it Rs. 1.38 crore.

Step 2 – Acquisition cost, two ways:

  • Old regime: Cost Inflation Index of 289 at purchase, 400 at sale. Indexed cost = Rs. 60 lakh × (400/289) = Rs. 83 lakh approximately
  • New capital gain tax: Rs. 60 lakh. No adjustment. That is the entire cost basis

Step 3 – Improvements: Renovation costs added to acquisition cost. Under old regime, these are also indexed.

Step 4 – Compare:

  • Old regime: Rs. 1.38 crore − Rs. 83 lakh = Rs. 55 lakh LTCG × 20% = Rs. 11 lakh tax
  • New capital gain tax: Rs. 1.38 crore − Rs. 60 lakh = Rs. 78 lakh LTCG × 12.5% = Rs. 9.75 lakh tax

New regime wins here. But for a property bought in 2005 for Rs. 15 lakh, the math reverses completely. Calculate both. Long term capital gains tax percentage after cess: approximately 13% under new regime.

Why is Understanding Long Term Capital Gain Tax Important?

One missed exemption: that is the most common avoidable mistake in LTCG on sale of property.

Section 54 can eliminate the entire tax. Section 54EC can eliminate the entire tax. Most property sellers in India pay LTCG when they did not have to , because no one told them these sections existed before the sale, not after.

Two other things that matter:

The 24-month holding threshold is not from the agreement date. It is from the date of acquisition or possession. Different by months in many cases. Getting this wrong converts LTCG into STCG.

The new capital gain tax regime for pre-July 23, 2024 property is a choice, not a mandate. The option to use the old 20% indexed regime is written into the Finance Act. Do not let anyone tell you otherwise.

What Rates Apply to Long Term Capital Gains Tax in India?

Post-July 23, 2024:Base rate: 12.5%Health and Education Cess: 4%Long term capital gains tax percentage: ~13% effectiveSurcharge above Rs. 1 crore total incomePre-July 23, 2024 property:Option A: 12.5% without indexationOption B: 20% with CII indexationFile whichever is lower. Both legal.

How to Minimize Long Term Capital Gains Tax?

There are three routes. Any single one can eliminate LTCG on sale of property entirely.

  1. Section 54 – Buy another house

LTCG goes to zero if you reinvest the gain amount in a residential property. Buy within 2 years of sale or construct within 3 years. The exemption is the lower of LTCG or the reinvestment amount.

Cap: Rs. 10 crore (since Budget 2023). If the purchase is taking time, park the amount in a Capital Gains Account Scheme (CGAS) within 6 months of sale. How to save capital gain tax without rushing the purchase: CGAS is exactly this facility. How to save long term capital gain via Section 54: the only condition is reinvestment. There is no income, age, or profession restriction.

  • Section 54EC – Buy specific bonds

How to avoid capital gains tax via Section 54EC: invest the LTCG amount in NHAI, REC, PFC, or IRFC bonds within 6 months of sale.

Maximum: Rs. 50 lakh per financial year. 5-year lock-in. The bonds pay interest, but that interest is taxable separately. Only the LTCG invested is exempt. A demat account is required when these bonds are issued in demat format.

  • Section 54F – Sold non-residential property.

How to reduce capital gains tax if you sold a plot or commercial property: reinvest the full net sale proceeds (not just LTCG) in a residential property. LTCG exempt proportionate to reinvestment. Reinvest everything: full exemption. How to save long term capital gain tax via 54F: the only difference from 54 is that 54F requires reinvesting proceeds, not just the gain.

What are Common Myths About Capital Gains Tax?

Myth: Budget 2024 removed indexation for all property.

Fact: Only post-July 23, 2024 property. Pre-July 23, 2024 property retains the old 20% indexed option.

Myth: Gift the property to avoid LTCG on sale of property.

Fact: Deferred, not eliminated. Recipient inherits the original purchase price and date.

Myth: New 12.5% rate is always better.

Fact: Not for property bought 15-20 years ago and calculate both.

Myth: Section 54 exemption is unlimited.

Fact: Rs. 10 crore cap since Budget 2023.

How Can Property Owners Benefit from Financial Planning Platforms?

Section 54EC bonds in demat format require a demat account for subscription and tracking. A KYC-verified demat account at Jainam Broking handles this alongside equity and mutual fund holdings. Open demat account via Aadhaar eKYC: 24 hours. Open demat account before the 6-month investment window closes, Section 54EC has a hard deadline.

For the calculation of old vs new capital gain tax on your specific property, consult a CA. The arithmetic is simple. Getting the correct CII values, improvement costs, and transfer charges is where errors occur.

Conclusion

12.5% or 20%, calculate both and file the lower one. Section 54, 54EC, or 54F: check before paying. Avoidable LTCG on sale of property is common. Taxpayers who understand what is long term capital gains tax and how the exemptions work keep more of their sale proceeds. Those who do not pay a tax they did not owe.
